The rules that govern Jewish Orthodox women’s bodies, in particular those of ritual purity and immersion, are often criticized as patriarchal and an expression of oppression or domination. This study challenges the structuralist analysis of the regimen of ritual purity by examining how religious women themselves live and experience this system. The authors interviewed 30 Orthodox Jewish women living in Israel who observe these rituals in an effort to hear their experiences. The women’s expression of their experiences moved beyond the (...) conventional, schematic abstractions of the oppression-empowerment dichotomy into a multitextured range of responses. This case describes the background of the whistleblower complaint, filed by Daniel Schlicksup, questioning the propriety of Caterpillar Inc.’s “Swiss tax strategy”. The Swiss tax strategy was recommended by its independent auditor, PricewaterhouseCoopers, and designed to transfer to a Swiss entity the profits earned on its sales of “purchased finished replacement parts” to foreign marketers. This strategy enabled Caterpillar to shift $8 billion in replacement parts sales to Switzerland and to avoid or defer paying U.S. taxes on that income. Daniel (...) Schlicksup, a member of Caterpillar’s tax staff, filed an Internal Revenue Service whistleblower complaint against Caterpillar and provided the IRS extensive documentation that served as the foundation for the IRS’s claim Caterpillar owed $2 billion in back taxes and penalties, potentially entitling Schlicksup to a huge whistleblower award ranging from $300 to $600 million. Careful review of this case facilitates student discussion, and enhances student understanding, of the wisdom and morality of Schlicksup’s whistleblowing activities. (shrink)

Humans can follow different social learning strategies, sometimes oriented toward the models’ characteristics. The goal of the present study was to explore which who-strategy is preferentially followed in the technological context based on the models’ psychological characteristics. We identified three potential who-strategies: Copy the pedagogue, copy the engineer, and copy the friend. We developed a closed-group micro-society paradigm in which participants had to build the highest possible towers. Participants began with an individual building phase. Then, they were gathered to discuss (...) the best solutions to increase tower height. After this discussion phase, they had to make a new building attempt, followed by another discussion phase, and so forth for a total of six building phases and five discussion rounds. This methodology allowed us to create an attraction score for each participant. We also assessed participants’ theory-of-mind skills, technical-reasoning skills, and prosocialness to predict participants’ attraction scores based on these measures. Results show that we learn from engineers because they are the most successful. Their attraction power is not immediate, but after they have been identified as attractors, their technique is copied irrespective of their pedagogy or friendliness. These findings open avenues for the study of the cognitive bases of human technological culture. (shrink)

The article discusses Leslie Marmon Silko’s Ceremony with a focus on textual manifestations of the figure of the trickster. The theme of shape-shifting and transformation that one usually associates with tricksters is linked here with the theme of (non)dualist timespace, the notion of interbeing, which in turn introduces the theme of trauma healing. The author combines two perspectives—Paula Gunn Allen’s view on timespace in her The Sacred Hoop, and Gerald Vizenor’s writings concerning trickster aesthetics—in order to show that the (...) narrative structure of the novel can also be seen as an embodiment of the trickster: trickster-timespace, trickster-relation, and trickster-processuality; these three manifestations of the trickster are analyzed from the perspective of one more actualization of the trickster, that of a psychopomp, the “Guide of Souls” (which is manifested both at the level of plot and narration). Published to coincide with the quincentennial celebrations of Columbus's ‘discovery’ of the New World, the Native American writer Leslie Marmon Silko's apocalyptic 1991 novel, Almanac of the Dead, is a harsh indictment of five hundred years of colonialism, racism and genocide in the New World. Silko clearly links this inhuman(e) history to the contemporary social policies of a range of nation states within the Americas, to present a variety of political issues that are of crucial significance to contemporary tribal (...) communities and other multi-national disenfranchised groups. Among others, this includes the significance of gender to constructions of American settlement and Federal-Indian relations, and to Silko's own status, and choice of literary topics, as a female (and Native) writer. This essay analyses Silko's disruption of authorized and sanitized state narratives, and of accepted (and acceptable) narratives of settlement; and considers Silko's use of the almanac form – the codex – of the pre-contact Aztec and Mayan libraries as a means to assert indigenous literacy, and to challenge the Euro-American claims to ‘civilization’ that are the basis for New World settlement. Most significantly, as its title suggests, Almanac of the Dead emphasizes the presence of the dead, both indigenous peoples and African slaves, to expose the real costs of settlement, and to actively un-settle the Euro- American reader. Consequently, Almanac of the Dead presents the powerful alternative histories of a range of dispossessed social and ethnic groups throughout the Americas, while relocating and reconsidering the US within the context of the Americas as a continental and historical whole, and emphasizing the positive potential of political activism. Ecofeminism is a term coined by Françoise D’Eubonne in her book Feminism or Death to show the affinities between ecology and feminism. Both women and nature are perceived as passive elements and like women who complain about patriarchal constraints, ecologists shed light on the impacts of human exploitation over nature which is affected by pollution. Some dimensions of ecofeminism are present in Leslie Marmon Silko’s The Yellow Woman. The postmodern novel contains a female character who forges a link with (...) the natural surroundings and is in a direct contact with some natural elements like plants and animals. What is specific about the heroine is that she escapes her matriarchal society and goes back to nature in order to reconstruct her identity. At the end of the narrative, the female narrator leaves the natural setting and goes back to her family to replay social roles. The present article sets out to study the importance of Mother Nature for the female narrator and to examine the affinities between Earth Mother and the female protagonist. The first part will offer a theoretical background about the basic principles of ecofeminism. Then, my analysis will touch upon the aspects of ecofeminism in the novel. However, the last part will focus on the way the narrator goes beyond her matriarchal culture and reshapes female identity. (shrink)

In 1998, Richard Rorty drew attention to a cultural tendency, most obvious in the contemporary novel, toward self-mockery or disgust. Citing the recent novels of Neal Stephenson (Snow Crash) and Leslie Marmon Silko (Almanac of the Dead), Rorty observed in this late twentieth-century writing a palpable condescension toward national pride. This was a literature in which it was no longer considered appropriate to take pride in one’s citizenship or nation, a writing “of rueful acquiescence in the end of American (...) hope.”2 Rorty’s fondness for binary oppositions led subsequently to a contrast between this contemporary writing and the socialist novels of the early twentieth century. His is ultimately an entitlement or rights ethic, rather than an aitial ethic of goal-purposive fulfillment for the individual, projected outwards for a common good scenario. While his rejection of goal ethics's inability to detail principles for distribution of goods is noteworthy, it does not appear that a tightened version of generic rights theory will come closer to either of Phillips's desiderata: a justification of moral reasoning apart from any theory of nature or a calculus for its application. Desan and Phillips wish to think against the limits of the human situation. For Desan, rising above limitation is a moral task and obligation facing us each, if there is to be a common future. His call is to be World Citizen in a Polis of Nations. Phillips's vision is more concrete, a distribution of benefits to benefit all with well-being and freedom. Even to list the changes and events which occurred in seventeenth century England is a difficult task: the century spans the period from the death of Queen Elizabeth to the Glorious Revolution and beyond, through the Civil War, the accession and exile (twice) of the Stuarts, the rise of science, the transformation of the theological and religious issues of the English Reformation, to name only the most obvious. To conceive a book, in the form of occasional essays, which not only addresses these changes and events but does so by establishing the connections which were present with European currents at the same time surely tempts fate, even when it does not tempt reviewers. BOOK REVIEWS 571 But Hugh Trevor-Roper is a master, both of the period under survey and of the form of the essay. With one exception, each of these essays began as a lecture or seminar paper, and the pleasantly legible style in which they are written must bear some trace of that origin. The occasional flashes of wit, mixed with rthe fairly non-technical style, make the book a joy to read and a welcome escape from the usually constipated style of scholarly prose. In his Introduction, the essayist clearly sets forth his thesis that English intellectual history does not exist apart from the currents of European intellectual history (a thesis for which Trevor-Roper has already staked a claim). That leads to what may very well be the major problem with these essays: its end is in its beginning. The list of names cited in these essays only partially coincides with the list of names in the index; the former is much longer than the latter. And while the style of the essay welcomes the reader to the period, it also throws up more names and places and events than can be explained or even annotated adequately. This occurs both on a large and on a small scale. The first essay, on "Nicholas Hill, the English Atomist" contains such a vast array of names that at times it becomes the prosopo· graphical equivalent of a telephone book. Milwaukee: Marquette University Press, 1992. Pp. iv +112. In this ambitious lecture Father Ernan McMullin recapitulates and refines a thesis that has guided his thought for the past forty years. In essence the thesis is this: precisely how science is made has eluded the best minds for centuries, and only in the work of Charles (...) Sanders Peirce, suitably emended by McMullin, has the puzzle finally been solved. " Retroduction " is the inference that makes science. Once this is understood, errors on what constitutes scientific method-those of Aristotle, Aquinas, Galileo, Newton, Bacon, Hume, et al.-can be rectified and one can see science for what it truly is: a complex process of theory appraisal that yields, not definitive truth, but well-established results to which assent can be given with at best "practical certainty," whatever that might be (pp. 91-96). Why McMullin should have chosen such a theme for an Aquinas Lecture is a question that defies reasonable answer. Surely one does not have to he so negative about the thought of Aristotle, Aquinas, and Galileo to advance one's ideas about science in the present day. What McMullin could easily have done, and he hints at this in the last two paragraphs of his lecture (pp. 97-98), is show how retroduction is itself simply a relaxed version of the demonstrative regress, the method actually endorsed by Aristotle, Aquinas, and Galileo. Such a retroductive version, fair enough, yields knowledge of a probable cause, the type of knowledge most typical of modern science. McMullin did not have to embark on the dangerous course of trying to prove that proof and certainty are forever beyond the grasp of science, or that never in the history of science has anyone established a definitive truth. That, in effect, is what McMullin has tried to do, and in the attempt to make the point he fumbles at almost every juncture throughout a very long lecture. To set the record straight more than a review is being re--·quested; perhaps a book, and even that might not suffice for those whose minds are made up. To understand the import of the lecture one must appreciate that it is hut a brief episode in a debate over demonstration in science that has been going on since McMullin first came to the University of Notre Dame in 1954. John Beck's fine study of the representation of the postwar American West, analyzes the cultural impact of the secret state's establishment of its arsenals, proving grounds and waste disposal sites after the Manhattan Project. The giant Southwest Defense Complex is registered, with acute and telling political energy, in texts by Cormac MacCarthy, Leslie Marmon Silko, Bradford Morrow and Don DeLillo, as a brute invisible energy field at the edges of national experience. This is one of the best studies of (...) the military-industrial complex on record, typified by sharp close reading, blistering and theoretically wise readings, and a sure-footed grasp of difficult and evasive histories and strategies of deception. Beck sketches relations between toxic waste disposal, repressive anti-marginal politics, Cold War megadeath and atomic culture with an eloquence and passion controlled by a cool theoretical head. The review article argues that Beck's study is a major contribution to the analysis of the artificial state of emergency instituted by the AEC and Pentagon deep within the United States. (shrink)

The grammatical manipulation and production of language is a great deceiver. We have become habituated to accept the use of well-constructed language to indicate intelligence, understanding and, consequently, intention, whether conscious or unconscious. But we are not always right to do so, and certainly not in the case of large language models (LLMs) like ChapGPT, GPT-4, LLaMA, and Google Bard. This is a perennial problem, but when one understands why it occurs, it ceases to be surprising that it so stubbornly (...) persists. This paper will have three main sections. In the Introduction I will say a little about language, its aetiology, and useful sub-divisions into natural and cultural. In the second section I will explain the current situation with regard to large language models and fill in the background debates which set the problem up as one of increased complexity rather than one of a qualitatively different kind from narrow or specific AI. In the third section I will present the case for the missing phenomenological background and why it is necessary for the co-creation of shared meaning in both natural and cultural language, and I will conclude this section by presenting a rationale for why this situation arises and will continue to arise. Before we do any of this, I need to clarify one point: I do not wish to challenge the ascription of artificial general intelligence (AGI) to LLMs, indeed I think agnosticism is best in this respect, but I do challenge the more serious, and erroneous, ascription of understanding, intention, reason, and consciousness to them. And so, I am making two points: an epistemological one about why we fall into error in our ascription of a mental life to LLMs, and an ontological one about the impossibility of LLMs being or becoming conscious. Developing an intellectualist account of skill, Stanley and Williamson define skill as a kind of disposition to action-guiding knowledge. The present paper challenges their definition of skill. While we don’t dispute that skill may consist of a cognitive, a dispositional, and an action-guiding component, we argue that Stanley and Williamson’s account of each component is problematic. In the first section, we argue, against Stanley and Williamson, that the cognitive component of skill is not a case of propositional knowledge-wh, which is (...) typically indexical. In the second section, we seek to show that Stanley and Williamson face difficulties in arguing for a generic claim about skill as a kind of disposition, and they fail to defend intellectualism about skill based on the dispositional account. In the third section we argue that Stanley and Williamson need a more detailed account of the action-guiding aspect of skill to avoid several difficulties, including a threat of a regress. We close with some lessons for the debate over intellectualism and anti-intellectualism about skill. (shrink)

Researchers have identified the phenomena of moral distress through many studies in Western countries. This research reports the first study of moral distress in Iran. Because of the differences in cultural values and nursing education, nurses working in intensive care units may experience moral distress differently than reported in previous studies. This research used a qualitative method involving semistructured and in-depth interviews of a purposive sample of 31 (28 clinical nurses and 3 nurse educators) individuals to identify the types of (...) moral distress among clinical nurses and nurse educators working in 12 cities in Iran. A content analysis of the data produced four themes to describe the nurses’ moral distress. The four themes were as follows: (a) institutional barriers and constraints; (b) communication problems; (c) futile actions, malpractice, and medical/care errors; (d) inappropriate responsibilities, resources, and competencies. The results demonstrate that moral distress for intensive care unit nurses is different and that the nursing leaders must reduce moral distress among nursing in intensive care. (shrink)

Although Sibawayh dealt with it in a scattered manner under different headings there have been different views on na't (adjective), which is gene-rally included in the tawabi group in Arabic syntax, and there have been debates around these views. Na't, which is categorized as a proper adjective and qualifies the meaning of man'ut (mawsuf), has different characteristics from the sentence elements that indicate the subject. Nahiv scholars have mostly divided na't into two parts: real and causal na't, and they have (...) formulated certain rules for these two parts in accordance with the structure of the Arabic language. Since na't and man'ut are accepted as nouns, the i'rab of na't is subject to men'ut. However, some examples in the Qur'an and some expressions used by the Arabs caused objections to the i'rab of na't being the same as men'ut. It is observed that these objected examples are the cases where men'ut is known and the exceptional cases of madih, zam and jarri jivar. It is also obligatory for the na't to conform to the man'ut in terms of ma'rifiyyah, nekiriyyah, custom and gender. While Sibawayh (d. 180/796) considered it qabh (ugly) for non-propositional words to be na't, scholars such as Ibn Hisham (d. 218/833), Ibn al-Ḥajib (d. 646/1249), and Abd ar-Rahman Jami (d. 898/1492) accepted that na't could be either propositional or non-propositional and cited many examples of na't in the case of non-propositional words. Scholars such as Ibn Jinni (d. 392/1002) and Ibn al-Hajib gave an explanation of the causative na't without naming it, scholars such as Ebu’l-Bekā al-Ukbari (d. 616/1219) analyzed the subject under the title of causative adjective or causative na't, and Halid b. Abdullah al-Azhari discussed it under the title of al-wasf al-majazi. The subject of our study is to examine the handling of na't, which is one of the sentence elements in the Arabic language, in the works written on the field, its parts, the dimension that affects the meaning and the controversial aspects. The aim of the research is to examine the rules that Sibawayh deals with in his al-Kitâb on na'ta and the objections of later Arab linguists to these rules, and to contribute to the field by revealing different views on the subject. In this paper, we examine Maduabuchi Dukor’s article titled “Divination: A Science or An Art?”, where he endeavours to demonstrate the character and nature of African science as well as explores the issue whether some practices in Africa can be accorded a scientific status. These tasks to explore and demonstrate the scientific nature of African practices led Maduabuchi Dukor to focus on divination as his working example; and specifically identified Ifa divination. In sum, Maduabuchi Dukor argues that African (Ifa) divination (...) is or can be made a science through formalization and quantification. The main thrust of his argument is that with the aid of formalization and quantification, divination as practiced in Africa can qualify as a science. Our contention as regards this exercise by Maduabuchi Dukor runs from the beginning of the article through to the end of it. That is, our critique of the article concerns some suppositions employed to build up the argument that supports the claim that (Ifa) divination is a scientific enterprise. In other words, the premises and the conclusion so provided, we argue, are full of contestations; and it is these contestations that we showcased in this paper. It is important to make it clear that our contention has nothing to do with the thinking of Maduabuchi Dukor that Ifa divination is a science or can be made to be so; rather, our contention is the suppositions that he deployed to articulate his thought. Neuropalliative care developed to address the needs of patients living with life‐limiting neurologic disease. One critical consideration is that disease‐related changes to cognition, communication, and function challenge illness experiences and care practices. We conducted an ethnography to understand neuropalliative care as a phenomenon; how it was experienced, provided, conceptualized. Personhood served as our conceptual framework; with its long philosophical history and important place in nursing theory, we examined the extent to which it captured neuropalliative experiences and concerns. Personhood contextualized complex (...) losses, aligning the impact of functional and relational changes. Cognition, communication, and functional alterations stretched conceptions of personhood, insinuating it can be relational, fluid, adaptive. Although normative conceptions of personhood guided research and decision‐making, ethical considerations suggested personhood could be transformed, remade. We consider the implications of our findings through three themes. First, we examine how literature on illness experience fails to integrate the realities of people living with and dying from neurologic disease; we counter this by interrogating the concept of experience. Second, we turn to Ricoeur's work on recognition to illuminate relational conceptions of personhood to inform care practices. Finally, we reflect on how personhood can bridge the gap left by functional changes, enhance relational engagement, and promote dignity at the end of life. (shrink)

This chapter focuses on the property that excited Kuhn's interest in thought experiments: conflict vagueness. This property often generates inconsistent beliefs but is not itself inconsistency. Although it is absent from most thought experiments, a substantial portion of the most provocative thought experiments do spring from this species of vagueness; for they motivate conceptual reform by touching a nerve of indeterminacy. Hence, study of conflict vagueness reveals the ways thought experiments restructure our conceptual scheme.

This chapter examines the hazards and pseudohazards of thought experiment. It attacks most skepticism about thought experiment as arbitrary. It argues that once the standards that are customary for compasses, stethoscopes, and other testing devices are applied, thought experiments measure up. They should be used as part of a diversified portfolio of techniques. Although all these devices are individually susceptible to abuse, fallacy, and error, they provide a network of cross-checks that make for impressive collective reliability.

This chapter illustrates the power of thought experiments by assembling influential thought experiments from the history of science. It lays out the book's plan to understand philosophical thought experiments by concentrating on their resemblance to scientific relatives. Points of difference between philosophical and scientific thought experiments give a preview of obstacles that must be overcome in the course of the campaign. Naive and sophisticated reservations about the philosophical cases are registered for the same purpose.

This chapter focuses on armchair inquiry. Thought experiment has the feel of clairvoyance, thus eliciting awe in some and suspicion in others. But the wonder of thought experiment is just a special case of our vague puzzlement about how a question could be answered by merely thinking. There is no mystery when investigators look, measure, and manipulate. Their answers come from the news borne by observation and experiment. But if you just ponder, then the information you have leaving the armchair (...) is the same as the information you had when you sat down. It is argued that part of our wonder is based on a modal fallacy. The theories of armchair inquiry that promise answers to the legitimate portion of our wonder are surveyed. Finally, a cleansing model of rationality that sets the stage for a detailed analysis of how thought experiments work is developed. (shrink)

This article aims to offer a fresh analysis of two passages in the extensive necromancy episode in Lucan's Bellum Ciuile: the ritual to reanimate the dead soldier's corpse (6.667–73), and the surgical procedure Erichtho then proceeds to undertake (6.750–7), resembling the practice of a vivisection. The study will focus mostly on the strong connection of magic to medical traditions in antiquity, with a commentary on, and analysis of, these verses through the lenses of medical vocabulary, themes and motifs. It ultimately (...) concludes that Lucan was familiar with the language and characteristics of the medical tradition, enriched his report with them, and was playing with his audience's knowledge of the same. It is based on the opinions of 15 hypothetical ethical/unethical business situations from the 81 managers who agreed to participate in the survey. The findings of this study showed that these Malaysian managers have high ethical values. However 53% of the respondents believed that the ethical standards of today are lower than that of 15 years ago. Apparently, this is related to the existence of many unethical business practices prevalent in (...) the modern business world. The behavior of one's immediate superior is the most important factor in influencing managers to commit unethical practices. The results also indicate only a slight variation among the managers in terms of perceived ethical values by virtue of job position, job specialization, type of business activity or the size of the business organization. Como se usa en este artículo, es una combinación de autoetnografía, etnografía y pedagogía crítica por la cual la investigadora se hace participante en el estudio, dirigiéndose al interior para examinar el Self y la complejidad de las perspectivas usando la lente de la pedagogía crítica. La reflexividad y la introspección intensas apoyan este estudio del Self como participante para ir más allá (...) del recuento de hechos tan objetivamente como sea posible, que es lo que ocurre con la autobiografía, para reconocer que la investigadora interpreta los hechos de su vida a partir de perspectivas culturales que se han formado por años debido a sucesos y circunstancias socioculturales, socio-históricas, sociopolíticas y socioeconómicas que le han ocurrido. Read and reinterpreted in the highly diverse circumstances across the American continent, Fichte's ideas are presented in a radically new light, uncovering the Fichtean spirit of self-activity and autonomous thought in an American context.

This chapter focuses on Thomas Kuhn's account of thought experiments. It begins with what Kuhn takes to be the smart talk about thought experiments. It then details Kuhn's amendments to this view and raises objections, most of which are directed against the notion of local incoherence. Finally, Kuhn's error is reconstructed in order to salvage the considerable insight that it contains.
